Welcome to Nadair Art. These terms explain the rules for using our website and buying from our store. Nadair Art is operated by Gridd Design LLC (“we,” “us,” “our”), and the store is at nadairart.com. By using the site or placing an order, you agree to these terms. If you don’t agree, please don’t use the site.
1. Who can buy
You must be at least 18 years old, or have a parent or guardian’s permission, to place an order. We sell and ship only to addresses in the United States.
2. Our products
We sell cards, postcards, and prints of original watercolor paintings. Every item is printed to order by a third-party print partner we work with through Printify, then shipped to you.
- Colors and sizes. We do our best to show our art accurately, but screens differ and printing is not an exact process. Small differences in color, brightness, and trimming are normal and are not defects. Sizes shown are approximate.
- Availability. Products and prices can change or be removed without notice.
- Descriptions. We try to keep descriptions and images accurate, but we can’t promise they are always complete or error-free.
3. Placing an order
When you place an order, you’re offering to buy the items in it. You’ll get an email confirming we received your order. That email is not our acceptance. We accept your order when we send it to be printed. We may refuse or cancel an order for any reason, including suspected fraud, a pricing or product error, or an address we can’t ship to. If we cancel an order after you’ve paid, we’ll refund you in full.
4. Prices, taxes, and payment
- All prices are in US dollars.
- The price you pay is the price shown at checkout, plus shipping and any sales tax that applies.
- We accept the payment methods shown at checkout, which are processed by WooPayments and PayPal. By paying, you confirm you’re allowed to use that payment method and you authorize us to charge it for your order.
- If we find a pricing error, we may cancel the order and refund you, or offer to ship it at the correct price. You can accept or decline.
- We may use fraud checks and may hold or cancel an order that looks suspicious.
5. Shipping and delivery
Delivery times, shipping costs, and tracking are described in our Shipping & Delivery policy [LINK]. Delivery dates are estimates, not guarantees. Risk of loss or damage passes to you when the package is delivered to the address you gave us. If a package is damaged, late, or lost, our Returns & Exchanges policy [LINK] explains what we’ll do.
6. Returns, exchanges, and cancellations
Because every item is made to order, returns and exchanges are limited to problems with your order, such as damage, a printing defect, or the wrong item. The details, including how to ask and how refunds work, are in our Returns & Exchanges policy [LINK], which is part of these terms.
7. Our artwork and your rights
All artwork, images, text, logos, and other content on this site, including the name Nadair Art, belong to [COPYRIGHT OWNER] or are used with permission, and are protected by copyright and other laws. Buying a card, postcard, or print gives you the physical item. It does not give you the copyright or any right to reproduce the artwork.
You may:
- display, give, and send the items you buy;
- resell or give away a physical item you bought, in its original form; and
- share photos of your purchase on social media, as long as you credit Nadair Art and don’t edit the artwork itself.
Without our written permission, you may not:
- copy, scan, photograph for reproduction, print, or sell copies of the artwork, or put it on other products;
- use the artwork or site content for commercial purposes, in advertising, or in any way that suggests we endorse you;
- use the artwork or site content to train, test, or improve any artificial intelligence or machine-learning system; or
- remove any signature, copyright notice, or credit.
If you’d like to use our work in some other way, such as for a wedding, a business, or a publication, please write to us at [CONTACT EMAIL].
8. Your account
You can check out as a guest or create an account. If you create one, please give accurate information and keep your password private. You’re responsible for what happens under your account. Tell us right away if you think someone else has used it. We may close an account that is used for fraud or breaks these terms.
9. Using the site
Please use the site only for lawful purposes. You agree not to:
- break any law or use the site to commit fraud;
- try to get into parts of the site or other people’s accounts that you aren’t allowed to access;
- use bots, scrapers, or automated tools to collect content or place orders, except as a normal search engine would;
- upload viruses or anything that could damage or slow the site; or
- interfere with anyone else’s use of the site.
10. Reviews, messages, and other content you send us
If you post a review, comment, or photo, you promise it’s yours to share, that it’s honest, and that it doesn’t break the law or anyone’s rights. You keep ownership of what you post, and you give us a free, non-exclusive right to display it on the site and in our marketing, with your first name or the name you used. We may remove anything that is offensive, misleading, or off-topic.
11. Other companies’ services and links
We rely on other companies to run the store, including Printify, WooPayments, and PayPal. Their services are covered by their own terms and privacy policies. The site may also link to other websites. We don’t control them and aren’t responsible for what they say or do.
12. Privacy
How we collect and use your information is described in our Privacy Policy [LINK].
13. Disclaimers
We work hard to keep the site running and the products as described, but the site is provided “as is” and “as available.” To the fullest extent the law allows, we don’t make promises beyond those in these terms, including that the site will always be uninterrupted or error-free. This doesn’t take away any rights you have under the law, including any right to a product that matches its description. Some states don’t allow certain disclaimers, so some of this may not apply to you.
14. Limits on our liability
To the fullest extent the law allows, we aren’t responsible for indirect or consequential losses, such as lost profits or lost data, that come from using the site or our products. Our total responsibility to you for any claim related to the site or an order is limited to the amount you paid for that order. Some states don’t allow these limits, so they may not apply to you. Nothing in these terms limits liability that can’t legally be limited.
15. If you break these terms
If your misuse of the site or violation of these terms causes us a loss or a claim from someone else, you agree to cover our reasonable costs from it, to the extent the law allows.
16. Governing law and disagreements
These terms are governed by the laws of the State of Virgina, without regard to its conflict-of-law rules. If you have a problem, please contact us first at help@nadairart.com. Most issues can be fixed quickly, and we’ll try to work it out with you in good faith for at least 30 days before either of us starts a legal case. If we can’t, any dispute will be handled in the state or federal courts located in Arlington, VA, and you and we both agree to those courts. You may also bring a claim in small claims court in your own county if it qualifies.
17. Changes to these terms
We may update these terms from time to time. When we do, we’ll change the “Last updated” date at the top and, for significant changes, put a notice on the site. The terms in effect when you place an order are the ones that apply to that order. Continuing to use the site after a change means you accept the new terms.
18. The legal basics
- Everything in one place. These terms, with our Privacy Policy, Returns & Exchanges policy, and Shipping & Delivery policy, are our whole agreement with you about the site and your orders.
- If part is unenforceable. If a court finds part of these terms unenforceable, the rest still applies.
- No waiver. If we don’t enforce a term right away, we haven’t given it up.
- Events outside our control. We aren’t responsible for delays or failures caused by things we can’t reasonably control, such as carrier problems, severe weather, or outages at our print partners or payment providers.
- Transfer. We may transfer these terms if we sell or restructure the business. You may not transfer your rights under them without our written permission.
